Enter our Hayes and Jarvis Holidaydream competition to be in with a chance of winning a prize of 1 (one) £5,000 (five thousand pound) Hayes and Jarvis Voucher to be redeemed against your Hayes and Jarvis dream tailormade holiday! 
 
How to enter: To enter, simply write up to 500 words describing your “dream tailormade holiday” and upload your entry via the Woobox App on the Hayes and Jarvis Facebook page -http://woobox/x5vrpt, together with your full name, email address and contact telephone number. Only online entries via the App on the Hayes and Jarvis Facebook page will be accepted. 
 
All eligible entries will be considered by a panel of judges who will select one entry from the eligible entries to win the prize. The judges will base their decision on which entry it considers to best fit the following criteria: fits the Competition theme, original, creative, good quality of writing and in keeping with the types of holidays offered by the Promoter. TERMS AND CONDITIONS FOR HAYES & JARVIS HOLIDAYDREAM COMPETITION 2014
 
1. The promoter of this competition (“Competition”) and prize is Hayes & Jarvis (Travel) Limited trading as Hayes and Jarvis (“Promoter”) whose principal place of trading is at The Atrium, London Road, Crawley, West Sussex, RH10 9SR (“Promoter Address”).
2. Eligibility: The Competition is open to residents of the UK, Republic of Ireland, Channel Isles and Isle of Man aged 18 years or over only, excluding employees and agents of the Promoter, other members of the TUI Travel PLC group of companies, anyone else professionally associated with the Competition and their immediate families.
3. No purchase necessary to enter. Internet access and Facebook account are required. 
4. The Competition will open at 12.01am (London time) on Monday 19 May 2014 (“Opening Date”).
5. The closing date for the Competition is at 11.59pm (London time) on Monday 30 June 2014 (“Closing Date”). 
6. All information detailing how to enter the Competition forms part of these terms and conditions. It is a condition of entry that all rules are accepted as final and that the entrant agrees to abide by these rules. The decision of the judges is final and no correspondence will be entered into. Submission of an entry will be taken to mean acceptance of these terms and conditions.
7. To Enter: To enter the Competition, the entrant must write up to 500 (five hundred) words describing their “dream tailormade holiday” and upload their entry via the Woobox App on the Promoter’s Facebook page – http://woobox.com/x5vrpt, together with their full name, email address and contact telephone number.
Only online entries via the Woobox App on the Promoter’s Facebook page will be accepted. We regret that we are unable to accept postal entries. In respect of online entries, the Promoter cannot guarantee continuous, uninterrupted or secure access to the website and is not responsible for any disruption to the Competition or the website due to technical problems or otherwise due to events outside of its reasonable control. All entries must be received by the Promoter by the Closing Date.
All eligible entries (validly and correctly submitted) will be considered by a panel of judges who, following the Closing Date, will select one entry from the eligible entries to win the prize. The judges will base their decision on which entry it considers to best fit the following criteria: fits the Competition theme, original, creative, good quality of writing and in keeping with the types of holidays offered by the Promoter.
The winner of the Competition will be notified by 6.00pm (London time) on Wednesday 30 July 2014 in writing by email to the email address provided in the winner’s entry. The accuracy of the email address is the responsibility of the winner. Acknowledgement of the prize by the winner must be received by the Promoter by 5.00pm (London time) on Wednesday 6 August 2014. Should the Promoter not receive such confirmation from the winner by this time, or in the event that the winner or substitute winner is unreachable or ineligible or declines to accept the prize, or a substitute winner fails to acknowledge the prize as specified by the Promoter, the winner or substitute winner shall forfeit the prize and the Promoter reserves the right to select an alternative winner from the remaining entries, applying the same criteria as set out above. The Promoter has no responsibility to anyone who has not responded in accordance with these terms and conditions. 
8. This Competition is in no way sponsored, endorsed or administered by, or associated with Facebook. To the maximum extent allowed by law, the entrant releases Facebook from any liability relating to the Competition.
9. The Promoter reserves the right (in its absolute discretion) to reject entries and disqualify entrants, including without limitation where the Promoter has cause to believe that (i) there has been a breach of these terms and conditions or the terms and conditions of any social media website where this Competition is featured or (ii) the entrant has interfered with the fair running of this Competition, including without limitation by manipulating entries or the results, or has provided false information or has acted unethically in any other way (including without limitation by using fake or multiple social media accounts to enter the Competition or vote, and by paying for votes).
10. Only one entry per person. Multiple, late, illegible, incomplete, invalid, defaced, or corrupt entries will not be accepted. For the avoidance of doubt, use of multiple Facebook accounts by the same person will not be accepted. The Promoter does not accept responsibility for IT failures, entries lost, damaged or delayed and proof of transmission, posting or sending will not be accepted as proof of receipt. Entries must not be sent through agencies, or by groups or third parties. The Promoter reserves the right to check the validity of entries and proof of identity may be requested by the Promoter from the entrant. 
11. Any entry submitted must be the work of the entrant submitting it and must not have been published elsewhere or have won any prize (including without limitation a runner-up prize) in any other competition. By submitting an entry, the entrant agrees and confirms that the entry does not infringe any rights of any third party. Entrants warrant that the entry they are submitting is their own original work and that they are the sole owner of the copyright in it. Further, entrants are entirely responsible for the content of the entries they submit. All entries must be of sufficient quality to publish. Entrants agree and confirm that, in relation to any entry they submit, it does not:
a. include anything that is pornographic, sexually suggestive, graphic, obscene, indecent, harassing, threatening, offensive, spam, unlawful, infringing, hateful, discriminatory, malicious, violent, or incites violence; 
b. include the entrant’s or anyone else’s private or confidential information in the 500 word element of the entry;
c. feature predominantly or solely a trademark or third party slogan;
d. contain viruses, trojans or other harmful elements.
12. Copyright in all entries submitted for this Competition remains with the respective entrant. However, in consideration of the Promoter providing the competition, each entrant grants a worldwide, irrevocable, unconditional and royalty-free licence, and all necessary rights and consents, to the Promoter and other members of the TUI Travel PLC group of companies, for the full period of copyright (i) to use any or all of the entries in any media including without limitation publications of the Promoter and other members of the TUI Travel PLC group of companies, the Promoter’s websites and social media and other members of the TUI Travel PLC group of companies’ websites and social media, and/or in any promotional material connected to this Competition, and (ii) to sub-licence such rights and consents to third parties.
13. The entrant waives all moral rights in respect of the use of its entry to which the entrant may now or at any future time be entitled under the Copyright, Designs and Patent Act 1988 or under any similar legislation from time to time in force anywhere in the world.
14. The Prize: 
a. There will be one winner of one prize. The winner of the prize shall win 1 (one) £5,000 (five thousand pound) Promoter Voucher. 
b. For the avoidance of doubt, the winner is solely responsible for all additional costs and expenses associated with its prize. The Promoter has the right to alter any aspect of the prize without prior notice if necessary to do so for any reason. 
15. The prize must be redeemed against a direct booking made with the Promoter on holidays offered by the Promoter to the same destination with a similar itinerary as described in the winning entry only before the expiry date of 30 June 2015 or it will not be valid. The Promoter Voucher can only be redeemed by following the instructions quoted in email correspondence from the Promoter to the winner. The Promoter Voucher can only be used against new bookings and cannot be applied retrospectively. The Promoter Voucher can only be redeemed by the winner named on the Promoter Voucher. The Promoter Voucher cannot be used in conjunction with any other special offers, discounts or promotions, including without limitation offers featured in weekly emails and press advertising. The Promoter Voucher can only be redeemed once and no refund is payable in the event that the full value of the Promoter Voucher is not redeemed. The Promoter Voucher will not apply again if the booking dates for the eligible booking with the Promoter are subsequently changed by the winner or if another booking is made after the winner cancels the first booking with the Promoter. In the unlikely event that the Promoter Voucher becomes unavailable, a suitable substitute of equal or greater value will be supplied. Full terms and conditions that apply to the prize will be forwarded to the winner. The Promoter’s Booking Terms and Conditions apply to all bookings made with the Promoter for its services and/or products and all bookings are subject to availability.
16. The prize cannot be awarded to any person who, for any reason, would not be allowed by law to purchase or use the prize.
17. The winner is not allowed to sell, transfer or auction the prize on to a third party.
18. Subject to these terms and conditions, the prize will be as published and is non-transferable. There is no cash alternative or exchange. No compensation will be payable by the Promoter if the winner is unable to use its prize as stated.
19. For information regarding the name of the winner, send a stamped and addressed envelope to the Promoter’s Address quoting ‘Winner: Hayes and Jarvis Holidaydream Competition 2014’.
20. The Promoter may use photographs, names, age and town/city of the winner in future publications and publicity, and may require the winner to take part in promotional publicity as specified by the Promoter, including without limitation being filmed, interviews, photoshoots etc. By entering the Competition, in consideration of the Promoter providing the Competition and the prize, the winner agrees to take part in such publicity and grants a worldwide, irrevocable, unconditional and royalty-free licence to the Promoter and all necessary rights and consents for the full period of any intellectual property rights to use the winner’s photograph, voice, likeness and/or image, and the name and age of the winner in any media without further payment or permission, for any future promotional activity. Furthermore, by entering the Competition, in consideration of the Promoter providing the Competition and the prize, the winner agrees to maintain and update social media for the Promoter about and throughout its prize holiday, including without limitation on the Promoter’s Facebook page, an online blog and any other of the Promoter’s social media pages at the Promoter’s discretion. These updates will be in the form of photos, videos, updates and a blog. Content must be sent by the winner to the Promoter via email on a minimum basis of at least once a day for the Promoter to the upload at its discretion to its social media pages. Any content submitted to social media sites by the winner must be the original work of the winner and where such content features third parties, the winner must obtain permission from any third party featured therein or their parents/guardians if children under 16 years old are featured, to use such content before it is submitted. By submitting any content, the winner agrees and confirms that the content does not infringe any rights of any third party. The winner shall be entirely responsible for any content it submits and such content must not and must not have breached any laws. The winner agrees and confirms that it will not submit any content that is pornographic, obscene, indecent, harassing, threatening or offensive, that includes anyone’s personal contact details, that features predominantly or solely a trademark or logo or that contains viruses, trojans or other harmful elements. Copyright in all material submitted by the winner shall remain with the winner. However in consideration of the Promoter providing the Competition and the prize, the winner grants a worldwide, irrevocable, unconditional and royalty-free licence to the Promoter and all necessary rights and consents for the full period of the copyright to use any or all of the content submitted by the winner in any media. The Promoter shall be entitled to sub-licence such rights and consents to third parties. The winner waives all moral rights in respect of the use of the content that it submits to which it may now or at any future time be entitled under the Copyright, Designs and Patent Act 1988 or under any similar legislation from time to time in force anywhere around the world. 
21. The Promoter reserves the right to modify, suspend, cancel or terminate the Competition, extend or resume the entry period, or change or withdraw the prize at any time without giving advance notice and will do so if an event occurs that renders the Competition itself or the awarding of the prize impossible due to reasons beyond the control of the Promoter (including without limitation reasons of force majeure) or if it cannot be guaranteed that the Competition can be carried out fairly or correctly for technical, legal or other reasons and the entrant agrees that no liability shall attach to the Promoter as a result thereof.
22. The Promoter has arranged the Competition in good faith but, to the fullest extent permitted by law, accepts no responsibility for and will not be liable for any claims, costs, losses, damages, expenses or liabilities, of any kind (including without limitation direct, indirect, consequential, incidental or punitive damages) arising out of or in connection with the Competition or with the acceptance, possession, use or any other aspect of any prize awarded. Your legal rights as a consumer are not affected. Nothing in these terms and conditions limits or excludes the liability of the Promoter for death or personal injury resulting from the Promoter’s negligence or for any damage or liability incurred by the entrant as a result of fraud or fraudulent misrepresentation by the Promoter or otherwise as prohibited by law.
23. If any court or competent authority finds that any provision of these terms and conditions (or part of any provision) is invalid, illegal or unenforceable, that provision or part-provision shall to the extent required, be deemed to be deleted, and the validity and enforceability of the other provisions of these terms and conditions shall not be affected. 
24. These terms and conditions are governed by English law and the Promoter and the entrant hereby submit to the exclusive jurisdiction of the English Courts.
